本期头条           国际航运劳工公约 (2006) 于今年820日开始生效. 它将永远改变船务的面貌,但对全球120万商船海员却带来更好的工作环境和待遇.公约生效后港口国检查员对船的检查将包括 MLC 公约的 14项要求.( 1).

 

The Maritime Labour Convention 2006 will come into force on August 20, 2013, changing the face of the shipping forever. The Maritime Labour Convention 2006 (MLC 2006) is a codification of all the previous ILO conventions that lacked wide ratification for various reasons. The far-reaching requirements, Flag and owner responsibilities as well as the mandatory regulations in Part A present unprecedented challenges to shipping. The new convention will affect over 1.2 million merchant  seamen according to ILO. Shipowners and Flag alike have a lot of work ahead before the enforcement date in order to ensure compliance of their vessels.

Port State Control Officers (PSC) boarding vessels in MLC signatory countries will have the authorization in Regulation 5.2.1 to inspect vessel for compliance in 14 areas. A Maritime Labour Compliance Certificate should be prima face evidence of the vessel’s compliance. However any observed infraction or complaints from crew members are evidence enough to dig deeper.

PSC is authorized upon arrival of a vessel to inspect 14 points that are:

 

1.        Minimum Age

2.        Medical Certification

3.        Qualifications of Seafarer

4.        Seafarers Employment Agreement

5.        Use of any licensed or certified or regulated private recruitment and placement services.

6.        Hour of work/rest

7.        Manning levels for the ship

8.        Accommodation

9.        On-Board Recreational Facilities

10.      Food and Catering

11.      Health and Safety and Accident Procedures

12.      On-Board Medical Care

13.      On-Board Complaint Procedures

14.      Payment of Wages

Although Flag Administration may grant exemptions in the areas of Accommodation and On-Board Recreation facilities, most of the other 14 points d not allow for exemptions, but do allow for equivalencies. The Flag is responsible to issue the DMLC’s Part I, the vessel owner may request exemptions and equivalencies from Flag. Acceptable requests will be put in writing in the DMLC Part 1 for all PSC officers to see. Then the owners will respond with a Part II. Once these two documents are properly completed, a Recognized Organization (RO) on behalf of the Flag will inspect the vessel and issue a Document of Compliance.

It is now possible for Danish ships engaged in international voyages to be surveyed and certified in accordance with the Maritime Labour Convention.
From 20 August 2013 the Convention will become effective in Denmark. This means that all Danish ships with a gross tonnage of 500 from that date must have a license if they want to sail to ports in other countries. With the Convention seafarers get straightforward, standardized rights. At the same time there will be a level playing field when it comes to seafarers' working conditions.
The Danish regulations that ensure that Denmark is implementing the Convention, are currently issued and shall become effective on the same date as the Convention.
The certification process started on 20 March 2013 and runs until 20 August 2013. Danish ships will be surveyed and certified before the Convention commences.

Bulk arms of Cosco and China Shipping tie the knot      为提高效率远和中海之散装部将合并为一

To cope with the complicated and difficult market situation, the bulk shipping arms of the two Chinese shipping giants, Cosco and China Shipping have inked a strategy cooperation framework agreement at Beijing, according to the State-owned Assets Supervision and Administration Commission (SASAC) of the State Council.
Cosco Bulk Carrier and China Shipping Bulk Carrier will work together on market information, ship and cargo arrangements, navigation, ship repair and shipping industry policy, to promote the recovery of shipping industry and the healthy development of bulk shipping sector, SASAC said.
It follows the news late last year that the two firms container divisions would cooperate on domestic routes.
Both companies, especially debt-laden Cosco, are under pressure from Beijing to work more closely together before they can expect further aid from the state.
